Zoning Requirements vs. Variances Requested by Pulte Homes
Following are the EXCEPTIONS to current zoning that Pulte is requesting in order to accommodate 84 homes into this small parcel:
- To reduce lot size from 40,000 sq. ft. to approximately 6,900 sq. ft. (a nearly 83% reduction);
- To reduce lot width from 125 ft to approximately 60 ft. (a 52% reduction);
- To reduce corner lot width from 150 ft. to approximately 63 ft. (a 58% reduction);
- To reduce front yard setback from 30 ft. to approximately 25 ft. (a nearly 17% reduction);
- To reduce corner side setback from 30 ft. to approximately 15 ft. (a 50% reduction);
- To reduce rear yard setback from 25 ft. to 0 ft. for Lots 1-9 (a 100% reduction); and
- To reduce Floor Ratio Area (F.A.R.) from 0.25 to 0 (a 100% reduction; in their submission to DuPage County, Pulte Homes indicates they seek to “eliminate the Floor Area Ratio (FAR) limitation under the Code”).

37-702.3: – LOT REQUIREMENTS: SIZE, WIDTH AND DEPTH (R-2).
Except as otherwise provided herein, a separate minimum ground area herein called the zoning lot, shall be designated, provided and continuously maintained for each building containing a permitted or conditional use, as outlined below.
37-702.4: – YARD, HEIGHT AND FLOOR AREA RATIO REQUIREMENTS.
Notwithstanding section 37-700.4 of this chapter and except as otherwise provided herein, each principal building located in the R-2 district shall provide for one (1) front yard, two (2) interior side yards or one (1) interior side yard and one (1) corner side yard, and one (1) rear yard.
Following is a side-by-side comparison of current R-2 single family zoning requirements and Pulte’s requested exceptions, ranging from 17% to 100% reductions in lot sizes.

Exceptions:
Average front yard less than minimum setback: On streets where a front yard setback has heretofore been maintained by buildings situated on lots or tracts comprising not less than fifty percent (50%) of the total street frontage on one (1) side of that portion of any street including: 1) lying between two (2) intersecting streets, 2) lying between one (1) intersecting street and the centerline extended of the nearest street connecting with, but not intersecting such street, or 3) lying between the centerlines extended or the nearest streets connecting with, but not intersecting such street, buildings shall maintain a front yard (building setback) as required in the zoning district in which such property is located, or may maintain a lesser front yard, as determined by the average front yard (building setback) provided by existing buildings.
Height: 36′ (except that where a lot size is 40,000 sq. ft. or more, the height of a building or attached structure may be increased 1′ for each 1′ all required yards are increased. The required yard increase shall be measured from the portion of the building or attached structure which exceeds the maximum height. In no case shall the height exceed 72′).
Annexation to West Chicago
Pulte Homes is also requesting annexation for the parcel to West Chicago. A public hearing was to be held regarding the Pre-Annexation Agreement on Monday, November 18, 2019 at 7 pm at the West Chicago City Hall, 475 Main Street, West Chicago. Pulte Homes withdrew their petition prior to this meeting taking place.
